Did some further testing and reviewing of the stored proc.
The exceptions only happens if there's a heavier load.
The sp is supposed return an RS only for specific cases which I'm not activating.
I added getMoreResult by default and the problem seem to have gone away. Even though technically I'm not using the result set.
