TargetDomainXML must exist?

1. Why is the target domain xml file required to exist in order to
create a Server object?
        It is overridden by the contents of the source xml plus any
changes made via the api, so its not obvious to me why it has to exist
initially.
        
        
2. When I do not specify the target domain xml it seems to over
write my source domain xml, no matter where in the file system I put the
file. I would have thought it would write it in the default location of
<instancedir>/config/domain.xml
