I'm not sure if I understand your point entirely, but here is my take:

- The beta release had a problem loading jaxb.properties from a jar file.
  This problem is going to be fixed in the next release.

- I don't understand when you say "the searchContextPath method searches
  only subdirectory of current working directory." I think the
  searchContextPath method searches the current classpath.

- If you need to load jaxb.properties from other sources, then how about
  creating an URLClassLoader and pass it to another version of the
  JAXBContext.newInstance method?
