Yes, this is a known problem with the JSR173 spec.
Measures were initiated to address this issue in a maintenance release of StAX, but unfortunately the timing had collided with the release of JavaSE6 which specifies StAX 1.0. Because StAX is part of JavaSE, the earliest that this problem can be addressed would be JavaSE7.
I was not aware of Apache Muse and the existence of the stax-api-1.0.1.jar, I'll look into this. The next version of StAX is 1.1 but the XMLOutputFactory method has not been fixed for the reasons that I mentioned earlier.
